1. General conditions of sale

These general conditions of sale (hereinafter “General Conditions”) have as their object the purchase discipline, carried out online on the website “www.consorziovaccherosse.it” (hereinafter “Site”), in compliance with the provisions of the d .lgs. n. 206/2005 and subsequent amendments and additions (hereinafter, the “Consumer Code”), and in particular from Section II, as well as from the rules on electronic commerce (Legislative Decree no. 70/2003).

The Red Cows Consortium SCA, based in Reggio Emilia, via F.lli Rosselli, 41/2 P.I. and C.F. 01463760353 is the seller of the Products and owner of the Site.

The Customer who accesses the Site to make purchases is required, before sending the order, to carefully read these General Conditions, which have been made available on the Site and which will be available for consultation at any time.
Any changes to the General Conditions will be promptly published on the Site.
In any case, for each order, the General Conditions published on the Site will be applied and accepted at the time of placing the order online.

2. Procedure for the purchase of the Products

2.1 Registration

To place orders on the Site you need to register. Registration is free.
The data required for registration are those necessary for billing and shipping (including a telephone number), as well as an e-mail address and a password.
The Customer is strictly prohibited from providing false and / or fantasy data, in the registration procedure necessary to activate the procedure for the execution of this sales agreement and the related further communications; the personal data and e-mail address must be exclusively real personal data.

2.2 Order

For the purchase of products, the Customer must access the Site, insert the desired products in the shopping cart and complete the order by following the instructions contained on the Site itself.

Before proceeding with the transmission of the Order, the Customer:

• must declare that they have read, expressly and fully accept these General Conditions by placing a flag in the appropriate box;
• can identify and correct any data entry errors by following the instructions on the Site.

By placing the Purchase Order on the Site and sending it, the Customer declares and guarantees to be of age and to have full capacity to act in relation to the stipulation and execution of the purchase and sale contracts, concerning the Products and to have read all the information provided during the purchase procedure.

2.3 Acceptance of the order

The acceptance of the order is communicated to the Customer through an email to the address that the Customer will have indicated during the purchase procedure on the Site. Acceptance of the order itself will contain a reference to these General Conditions, the order number , the shipping and billing data, the list of Products ordered and the relative price, the transport costs and the total of the order itself.

2.4 Refusal and cancellation of the Order by Consorzio Vacche Rosse sca

The Red Cows Consortium reserves the right to refuse or cancel orders that come from customers with whom there is a legal dispute in progress or who have previously violated the General Conditions or who have communicated false, incomplete or in any case inaccurate identification data.

2.5 Cancellation of the order

It should be noted that, upon receipt of payment confirmation from the Red Cows Consortium, the order can no longer be canceled.
Due to unforeseen logistical and organizational difficulties, the Red Cows Consortium may cancel the Order by notifying the Customer via email or, subject to agreement with the same, change the day and / or place of delivery.

2.6 Changes to the order

It should be noted that once payment has been made, the order cannot be changed.

3. Products

3.1 Product features

The characteristics (technical data sheet) and the price of the various products on sale are shown on the respective page. Product images are for illustrative purposes only and may differ in color and size from the products delivered.
The packaging of the products delivered may not coincide with that shown on the Site.
In the event of a difference between the image and the written product sheet, the description of the product sheet always prevails.
The information provided should be used for general information purposes only and not as a substitute for any form of advice.
The products must be stored in the manner indicated on the label and consumed within the term indicated on the same label.

3.2 Products with variable weight

Variable weight products are products whose actual weight is determined only when they are prepared. For this reason, the actual weight of these products may vary from what is indicatively proposed on the Site. The Red Cows Consortium will not request any addition to the price paid during the order.

3.3 Fresh and ricotta cheeses

Fresh and ricotta cheeses are naturally perishable by nature. To ensure maximum freshness, orders containing this type of product may require a few more processing days than indicated in the following article 6.

4 Prices and delivery costs

All the prices of the products published on the Site are expressed in euros, include VAT and do not include transport costs.
The costs vary according to the weight of the order and the delivery location, they are shown VAT included and re-proposed in the confirmation of the Purchase Order.

It was therefore natural for us to face the outbreak of the pandemic more than a year ago with even greater commitment and responsibility towards the community. This is why, among the various actions we have taken, there is the special one concerning the purchases on our online shop and with which we still contribute to the costs of the courier that brings them to your home.

5. Methods of payment and billing

5.1 Payment methods

The customer can pay for the order through one of the following methods:

• with the credit or prepaid cards indicated on the site;
• paypal;
• payplug;
• advance bank transfer (bank details useful for payment are indicated in the order confirmation).

Payments made by credit card, or with other electronic forms, will be made through a secure connection, using the Visa, Mastercard and Pay Pal services. The Customer will pay for the purchases with the Credit Card without sharing the financial information with Consorzio Vacche Rosse which, therefore, cannot be held responsible for any fraudulent use of the card in question. 5.2 Invoicing

The Customer is responsible for the billing data entered during the registration of his account and sending the order.
In the event that the Customer requests the issuance of an invoice and / or in any case is not a “consumer or user” as defined in art. 3, paragraph 1, lett. a) of the Consumer Code, the withdrawal regulation pursuant to art. 7 of these General Conditions nor, more generally, the provisions that pursuant to the same Consumer Code apply only to “consumers”.

6. Transport and delivery

6.1 Method of delivery

The Red Cows Consortium delivers on the national territory by refrigerated courier, while in Europe by express courier, using a system of certified packaging and specific accessories for food shipments. The Products purchased on the Site will be delivered to the address indicated by the Customer, during the purchase procedure, in the appropriate “Shipping address” field.
On the day the order is placed with the Courier, the Red Cows Consortium will send an e-mail confirming the shipment and a copy of the Transport Document. It is the Customer’s responsibility to verify the delivery data indicated in the transport document. The Red Cows Consortium reserves the right to request the customer for the higher transport and storage costs, possibly incurred in relation to the change in the delivery address.

The delivery of the order usually takes place within 10 days of payment of the order and according to the provisions of the courier delivery program.
In some periods of the year (for example during holidays) delivery times may be longer due to the high number of orders to be processed. In these cases, the Red Cows Consortium will inform the customer of possible delays. Furthermore, we specify that it is not possible to indicate preferred delivery times.
The Red Cows Consortium will not be held liable to the Customer for delays or non-execution of contractual obligations caused, directly or indirectly, by causes of force majeure beyond its control, such as: natural phenomena of particular intensity , war events, strikes, unexpected restrictions ordered by the authorities, etc.

6.2 Recommendations for the collection of the goods

At the time of delivery of the Products, the Customer is required to check that the packaging is intact, not damaged, nor wet or otherwise altered, even in the closing materials.

In particular, the Customer or the person in charge of collecting the order is required to:

1. check the integrity of the packaging and the number of packages before the courier;
2. if the packaging is damaged (creases, breaks, bumps, etc.), indicate the damage on the delivery note and take photos (to be sent together with the report)
3. sign subject to specific control of the content;
4. if the courier does not allow to add the reserve, reject the goods;
5. in the event that the packaging is intact, but the material inside is damaged or does not correspond to what was ordered, report the problem within 2 working days of receiving the goods to our number + 39 522 294655 or to the email info@consorziovaccherosse.it

7. Right of withdrawal

Perishable products and products made to measure or clearly personalized are excluded from the right of withdrawal. For other products, the customer has the right to withdraw from the purchase contract for any reason, even partially, without the need to provide explanations and without any penalty.
To exercise this right, the Customer must send a communication to the Red Cows Consortium within 14 days from the date of receipt of the Products.
This communication must be anticipated by e-mail and subsequently confirmed by registered letter with return receipt or by certified e-mail (pec) to the address suppliers@pec.consorziovaccherosse.eu, within the following 48 hours.

Communication via email:

• must be sent to the address: info@consorziovaccherosse.it;
• must contain in the object the explicit reference to the RIGHT OF WITHDRAWAL and the order number.

The registered letter with return receipt, must be sent to the following address:

The Red Cows Consortium will, once the communication has been received, open a practice for managing the return and inform the Customer about the products for which the return is possible.

The Customer must therefore return the product, at his own expense, to the following address:

In case of exercise of the right of withdrawal, the Customer undertakes to keep the products for which he intends to exercise the right of withdrawal, in compliance with what is stated on the label, using the original packaging for the return, together with all the accessories and documentation they come with. The Customer is requested to return the products without undue delay and in any case within 14 days from the date of communication of the withdrawal.
The Red Cows Consortium will refund the customer the full amount of the returned products, upon actual receipt of the same, provided that the conditions set out in the previous paragraph are respected.
The refund will be made by bank transfer to the bank details communicated by the Customer.
The withdrawal rules exclude those customers that are not attributable to consumers, or customers who request the issuance of the invoice indicating their VAT number.

8. Privacy

The Red Cows Consortium will process the Customer’s personal data, in compliance with the privacy legislation, as specified in the “Privacy Policy” section.

9. Applicable law and jurisdiction

The sales contract between the Customer and the Red Cows Consortium is understood to be concluded in Italy and governed by Italian law. For the resolution of disputes relating to the interpretation, execution or resolution of these General Conditions or individual purchase orders, the Court of Reggio Emilia will have exclusive jurisdiction.
